Dayton, Ohio (AP) - A judge has removed himself from the case of a Dayton woman accused of killing her baby by burning her in a microwave.

Visiting Montgomery County Common Please Court Judge John Kessler on Tuesday filed an order stepping down from the case of China Arnold, who has pleaded not guilty to aggravated murder. If convicted, she could face the death penalty.

Kessler cited his retirement and the need to avoid any appearance of being partial as reasons for stepping down.

Kessler declared mistrial on Feb. 11, finding that new defense witnesses bolstered Arnold’s claim of innocence in the death of her daughter, Paris Talley.

 china-arnold.jpg Latest Developments:  Just before judge Kessler declared a mistrial in Arnold case, father comes fourth.

The series of events that prompted judge Kessler to announce a mistrial on Monday February 11, 2008, stem from a Fairborn, OH man’s 7 year old son ( he was 5 year old at time baby Paris Talley died) claiming to have removed baby Paris Talley’s body from a microwave oven.

Fairborn man’s son, identified an older child (his cousin) as the person who may have put baby Paris Talley in the microwave. The 7 year old boy told his father the older child (his cousin) has a history of putting cats, baby dolls and other objects into microwaves and his parent(s) are fully aware of him doing this.

There will be no trial today judge Kessler gave the jury a day off.  On Monday closing arguments will be presented jury will go into delibration. The verdict should be handed down sometime Tuesday.

In court again today hearing testimonies from key individuals selected by the prosecution team. The prosecution team plans to wrap up today, then defense team will present their evidence and call witnesses.

Courtroom X-tra’s:  It was a Party! going on right outside the courtroom. China Arnold supporters -vs.- Terrell Talley (the father of murdered Paris Talley) supporters. You could not help but notice the tension in the hallway.  All of Arnold’s supporters mingled close to the court room doors, while Terrell Talley’s supporters migrated toward the center of the hallway.

While waiting to go inside the court room members from both sides where loud and obnoxious. They where dressed like HOT-GHETTO MESS (silver high heel shoes, pure white pants outfits, long dangling earrings (big as chandeliers), hair-do’s (pasted down with AmiPro hair gel), a variety of hair waves and weaves (lookin’ like a scene out of Bonner Brother’s Hair Show).

Some of Arnold’s supporters had a meeting in the ladies room, discussing how they were going to go shopping for outfits to wear to court the next day (like they were getting for a Jay-z concert), and what bills wouldn’t get paid because they had to LOOK GOOD.

Both sides moved back into the courtroom and was told by the Sheriff that if they continued arguing and pointing fingers outside in the hallway, that they would be banned from the trial proceedings. 

Some X-tra, X-tra:  The accused killer’s oldest two boys are bi-racial. She has 4 children; 3 boys & 1 daughter with three baby daddies.

Today, Terrell Talley testified about the events leading up to his three week old daughter’s death. Every other word out of Talley’s mouth during his testimony was a curse word.  He showed his true ignorance on the stand in the testimony against his child’s killer. 

 He testified that he was playin’ Madden Football (but really sellin’ drugs).  He was a drug dealer and had spent time in the joint (a whopping 60 days in the county jail).  He was loud, cocky, and even argued with Arnold’s attorney, John Rion Jr. several times.  His testimony was a COMPLETE DISASTER and so was HE!

The original 12 man jury consisted of 6 white men, 5 white women, 1 black women, and 2 alternates, by the end of day four one of the original juror’s was dismissed and replaced with an alternate (a black women). Now, the final 12 man jury consisted of 6 white men, 5 white women, and 2 black women.

The prosecution team called the lead detective (Doyle Burke) and several expert witnesses too testify. As prosecution team showed various exhibit’s of China’s daughter (little Paris Talley) on the overhead projector, Ms. Arnold became very emotional and requested to leave the court room. The trial proceeded without Ms. Arnold in attendance.

Day 4 of China Arnold’s Trial - Opening Statement & Testimonies

Explosive testimony:  Ms. Arnold’s then jail house female lover (Linda Williams - China succumbs too gay for the stay)  walking everybody in the court room through the series of events, how she (China) confessed too single handily killing her daughter (little Paris Talley).

 An Exhibit - was the garment China’s daughter (little Paris Talley) was wearing when she was killed.

 An Exhibit - was the kitchen appliance (murder weapon, microwave oven) that was used in the death of her daughter (little Paris Talley).

In front of the court room the prosecuting team demonstrated how the baby (little Paris Talley) looked in the microwave oven, by sitting a clear box on top of the microwave oven. Prosecuting team preceded to stuff a fake (baby alive) doll into clear box, baby alive did not fit.

A voice from the dead echoed, “IF IT DOES NOT FIT, YOU MUST AQUIT” (a famous quote said by: Attorney Johnny Cochran used this statement in the infamous O.J. Trial).
